GREATER MANCHESTER FUNERAL SERVICE LIMITED - TERMS OF BUSINESS
Greater Manchester Funeral Service Limited is an independent family run business, with one main shareholder, company director and proprietor Mr Michael William Kennedy. We are not at present part of any outside funeral legal organisation such as SAIFE or The National Association of Funeral Directors and do not subscribe to their current Code of Practice, However we aim to act in a professional manner and provide a sensitive, dignified service to all our bereaved families.
1. Estimates and Funeral Expenses
All dates and times provided on the estimate cannot be guaranteed untl tinal bookings are made and confirmed. However, there may be instances where because of circumstances beyond our control, we are unable to fulfil our obligations to you on the date or time requested by you at the time of making the arrangements. Where this is the case we will attempt to contact you in advance, using the details attached, and advise you of any alternative arrangements.
All Estimates must be paid in FULL prior to the funeral being undertaken, a delay in payment will hold back the funeral being arranged and completed. All our estimates are an indication of the charges to be incurred from the information collated during the funeral arrangements, where every effort is made to ensure the estimate is calculated correctly. The charges are liable to alteration, particularly where third parties change their rates of charges. In some cases we may not know these amounts at the time or providing the estiffiale, however, we will give a nearest amount, which will be claritied and shown clearly on the final funera invoice.
If you amend your instructions after the estimate has been given, the additional costs will be added and shown clearly on the final invoice for immediate payment.
2. Payment Arrangements
The final account will be sent after the funeral, any additions will be clearly shown. This invoice must be paid within 21 days from date of invoice, unless otherwise agreed by us in writing. Payment can be made via BACS bank transfer (please find our bank details below these terms), debit or credit card by telephone or in person. If you fail to pay us in full on the due date we may charge you interest:
at a rate of 2% above our bank's base rate from time to time in force:
calculated (on a monthly basis) from the date that our account was posted until payment is made in full;
We will request for all cost to be added to the outstanding amount if we have to take any of legal action to recover the payment of the outstanding funeral charges (unless a court order states otherwise).
3. Indemnity
You are to indemnify us in full from all expenses and liabilities we may incur (directly or indirectly) including financing costs and including legal costs following any breach by you of any of your obligations under these terms. This means that you are liable to us for losses we incur, for example:
We receive a cheque from you which is subsequently not honoured
We write to send you any reminder letters advising you that an account is overdue.
We are forced to instruct a debt collection agent, of which we will also recover the fees we incur from you.
We may claim those losses from you at any time and if we have to take legal action we will ask the court to make you pay our legal costs.
4. Data Protection
Words shown in italics are defined in the Data Protection Act 1998 ("the Act")
Any information given freely to us by you our client will be respected with the highest level of confidentiality especially any personal data such information will be held securely and processed for the purpose of carrying out our services to you our client. However in most cases, for us to fulfil our obligation to you for the service you have requested, we may need to pass such data to third parties and those third parties, who are performing part of the funeral services for you, as they may contact you directly. Under the Act you have the right to know what data we hold on you and can, by applying to us in writing and paying a fee of £50.00 (Fifty Pounds), receive copies of that data.
5. Cancellation and Termination
There is a 10 day cooling-off period should you wish to cancel our services. However if you have already given instructions and paid the estimate as in 1 & 2 of the above terms and we, Greater Manchester Funeral Service Ltd have incurred charges not already paid for in section 1 & 2 above, these payment will be deducted before any refunds are given.
We reserve the right to terminate our services if we feel you will not honour your obligations under these terms.
PLEASE NOTE: We will only obligate your termination by means of written instruction
If you request to terminate our services or we decide to terminate our services, You will also have to pay our charges according to the scale set out below:
Termination within 2 days of due date for performing the Funeral £500.00 (Five hundred pounds)
Termination within 1 week of due date for performing the Funeral £200.00 (Two hundred pounds)
Termination within 2 weeks of due date for performing the Funeral £150.00 (One hundred and Fifty pounds)
6. Conduct
Our Company standards of Practice are that we provide a high quality of service to you, in all areas of our service. If at any time you have any questions or concerns about the services we are providing to you, please raise them in the first instance with the Funeral Director arranging the funeral with you. If that does not resolve the problem to your satisfaction then please contact our company Director and sole main shareholder Mr Michael William Kennedy in writing at Greater Manchester Funeral Service Limited, KENNEDY HOUSE, 324-330 Moston Lane, Moston, Manchester M40 9JS or telephone 0161 681 1864.
If he is unable to resolve your issues for you satisfactory then you can make contact with The Funeral Arbitration Scheme at 618 Warwick Road, Solihull, West Midlands. B91 1AA, who provide independent conciliation and arbitration through the Chartered Institute of Arbitrators.
7. Agreement
Your continuing instruction will amount to your full acceptance of these terms of business.
Any waiver or variation of these terms are fully binding unless: You make a request to be recorded in writing, or a request is placed and signed by your acting as our client.

Nothing in these terms restricts or limits our liability for death or personal injury.
English law is applicable to any contract made under these terms. The English and Welsh courts have non-exclusive jurisdiction.
